For the needs of the Federal State Unitary Enterprise "UVO of the Ministry of Transport of Russia" in 2018 in the amount of 195 million rubles.


For the needs of FKU "Uprdor Moscow — Nizhny Novgorod" at the initial maximum price of the contract in 2019, it concluded state contracts for a total amount of 40 million, in 2020 for the amount of 108 million rubles


When implementing facilities for the needs of Federal State Unitary Enterprise "UVO of the Ministry of Transport of Russia", FKU "Uralupravtodor", FKU "Uprdor Moscow — Nizhny Novgorod" by A.V. Borisov, contracts were concluded with contractors affiliated with him — MF ENGINEERING LLC, S-DSU 111 LLC in order to develop budget funds for purposes other than their intended purpose.



In accordance with the Decree of the Government of the Russian Federation of January 26, 2017 No. 100-r, FSUE "UVO of the Ministry of Transport of Russia" was determined as the sole contractor for the following:


I. FKU Uprdor "Taman" procurement of works related to engineering surveys, design and equipping with engineering and technical systems to ensure transport security (with commissioning) of a transport crossing through the Kerch Strait as part of the event "Ensuring transport security in terms of equipping the object" Construction transport crossing through the Kerch Strait" engineering and technical systems (means) to ensure transport security for the period of construction and operation" of the federal target program "Socio-economic development of the Republic of Crimea and the city of Sevastopol until 2020", approved by the Decree of the Government of the Russian Federation of 11.08. 2014 No. 790 "On approval of the federal target program "Socio-economic development of the Republic of Crimea and the city of Sevastopol until 2020" (hereinafter referred to as the Development Program of the Republic of Crimea and the city of Sevastopol).


The contract TB-32 dated February 17, 2017 was signed for the amount of 4,369,498 thousand rubles in 2017 prices. Based on the results, the savings amounted to 231,485.538 thousand rubles. (exemplary).


During the fulfillment of obligations under the Contract, the Contractor repeatedly allowed delays in the scope of work provided for by the calendar schedule for the development of working documentation and for equipping the facility with engineering and technical systems to ensure transport security, in view of which, in 2018 and 2019, the Customer sent requests for payment of fines , including applying to the bank as a guarantor under the current contract (VTB PJSC).


At the same time, on April 30, 2018, the Government of the Russian Federation amended the Decree of the Government of the Russian Federation dated January 26, 2017 No. 100-r regarding the shift in the timing of equipping the transport crossing through the Kerch Strait with engineering and technical systems to ensure transport security until December 1, 2019 (the previous deadline completion of works: A / D part — 04/30/2018; Railway part — 12/01/2019).


On November 30, 2019, by Order of the Government of the Russian Federation No. 2890-r, the completion date for equipping the railway component of the transport crossing was postponed from December 1, 2019 to June 1, 2020.


On 06/03/2020, the Government of the Russian Federation issued Decree No. 1466-r, in accordance with which the deadline for the execution of the state Contract can be postponed until 12/01/2020. On the basis of which FKU Uprdor "Taman" and FSUE "UVO of the Ministry of Transport of Russia" signed an additional agreement dated 06.29.2020 No. 25 to the Contract with the postponement of the work performance until 01.12.2020.


According to the Contractor, the postponement is due to the inability to simultaneously carry out work on equipping engineering and technical systems to ensure transport security of the transport infrastructure facility, performed by FSUE "UVO of the Ministry of Transport of Russia", and the main construction and installation work on the construction of a transport crossing across the Kerch Strait, performed by LLC " SGM. In this regard, there was a delay in the schedule for the production of work on equipping the railway component, and the start of preparatory work on equipping became possible only in April 2019. In this regard, it became possible to complete the installation and commissioning work on equipping a security television system with intelligent video surveillance, a video and audio recording system and means, a collection and processing system, a security lighting system and power supply, it became possible to complete before the end of May 2020. The contractor also indicates the reason — the occurrence of force majeure circumstances in connection with the pandemic declared by the World Health Organization due to the outbreak of the 2019-nCoV coronavirus infection and the introduction by regulatory legal acts of state authorities of prohibitive and restrictive measures aimed at preventing its spread, as well as other instructions Government of the Russian Federation.


It should be noted that:


1) During the implementation of the contract, changes were made to the calendar schedule four times with the postponement of work, including in accordance with the Orders of the Government of the Russian Federation (DS dated 06/29/2018 No. 7, DS dated 11/21/2018 No. 9, DS dated 01/24/2019 No. 20 and DS dated June 29, 2020 No. 25).


2) The number of orders for violation of state requirements shock contract issued by the building control service amounted to 12 pcs. for the entire period of construction. To date, all orders have been fulfilled.

Due to the fact that the payment of the fine was not made within the established period, on April 13, 2018, FKU Uprdor Taman sent a request for the payment of the amount of money under the bank guarantee to VTB Bank (PJSC), which is the guarantor to the Customer under the bank guarantee provided by the Contractor upon conclusion of the Contract. On April 20, 2018, VTB Bank (PJSC) secured the transfer of penalties to the Customer at the expense of collateral under the Contract.


In 2019 In view of the delays allowed by the Contractor in terms of the scope of work provided for by the calendar schedule for the production of work on the development of working documentation and on equipping the facility with engineering and technical systems to ensure transport security, addressed to the Contractor FKU Uprdor "Taman", letter dated 06/25/2019 No. 1 / 1746, sent a request to pay the amount of a penalty in the amount of 29,793,412.24 rubles by 05.07.2019 due to the delay in fulfilling the obligations stipulated by the Contract. FKU Uprdor "Taman" filed a lawsuit to recover a fine from FSUE "UVO of the Ministry of Transport of Russia" in the amount of 29,793,412.24 rubles.


As part of the meetings of the Ministry of Transport of the Russian Federation under the chairmanship of the Deputy Minister of Transport of the Russian Federation, instructions were given to the Federal State Unitary Enterprise "UVO of the Ministry of Transport of Russia", which subsequently were not executed on time, which in turn also had an impact on the improper fulfillment of obligations under the Contract.

Failure to fulfill the contract on time was poor-quality prepared project documentation, incompetence of employees of contracting organizations, and even the main contractor itself.


The equipment of the systems for the period of construction was carried out by the contracting organization MF-Engineering, the automotive component was equipped by the organization SDSU-111 LLC.


At the end of the construction period (MF Engineering), the prosecutor’s office of the Southern Transport, Krayevoi, FSB has many questions, now the OBEP from Anapa are working on these issues.


For the automotive component, taking into account the deadlines for completing work before 12/01/2020, it was decided to accept it as it is, with the condition that


SDSU-111 will correct all the shortcomings until 01/10/2021 (Connecting systems from the hell of the approaches of the region and Crimea to the EPUOTTB, SPDI, telephone and radio communications, access control systems, notification, bringing to mind SOT, etc.) but this was not done, and as a result, additional problems with SPDI, which led to an even more unstable operation of the system. Federal State Unitary Enterprise "UVO of the Ministry of Transport of Russia" A.V. Borisov were not fulfilled. The reason for this was the insolvency of SDSU-111 LLC, which, in principle, had not previously performed such volumes and is not a specialized organization for transport security systems. The big question remained about the RVI video cameras installed at the facility, which were installed instead of the design Hikvision. These changes to the project were strongly lobbied by Borisov himself. The cameras showed themselves very poorly, a very large percentage of defects, unstable operation, especially at night, and greatly affect the operation of intelligent video surveillance in general. For example, on the railway, the design solution was left as a component, the operation of the system was noted as stable without any complaints.

What is known:


The following facilities are to be built under this contract:


- SIDRK for the inspection of the railway train at the station. Bagerovo;

The lack of 100% construction readiness of the station was noticed by the president himself during the opening of the railway component in December 2019, for which the Minister of Transport flew hard in the cabin of the diesel train in which they were traveling.
